Who owns the site files... Work for hire laws in Canada?

Hey all,

I have a situation... My wife paid another performing artist to create a website for her, which in their arrangements included hosting.
For my understanding this is a work for hire, since he would not have made this website otherwise, without her payment.
Is this the same in Canada as it is the states?

http://en.wikipedia.org/wiki/Work_for_hire

Now that the registry of her URL is coming up, he does not want to send us the files for the site so we can reload it onto the hosting plan that I have for my websites. He claims it is not their policy to release files. We like the base design, while the mystery meat navigation is slow and buggy, the base of the design is nice. We offered to keep his design credits unless a complete overhaul occurs, since we like the visual layout. For my knowledge, my wife paid for:
1. graphic design of the site
2. hosting from web release until this summer, seperately from basic design cost
3. registry of her URL, which was put in her name under his business.

What to do?
Do we keep the base design and re-script the back-end if he chooses to not send the files of the complete site?
What exactly are you buying when you contract for a site to be built, if not the files that comprise the site?
Recommendations?

Many thanks,
MT

share artistic studio space with me and some keen folks!

I am with a group of 3 others that are looking for one more artist to share affordable studio space to create wondrous artistic creations. We also intend to be a supportive community that helps each other to realize our artistic dreams.

I am a painter, Melly makes burlesque related costume, Jessica is a photographer, and Kiva makes jewelry and other items out of reclaimed materials. I personally would love to have another painter involved.

We plan to host monthly events such as art shows, performances, screenings, or installations. We also plan to offer workshops to the public, so if you have some wisdom to offer, this may be a venue for you to get some exposure and earn some extra income.

We have found a storefront location next to a darkroom cooperative and across from the Heaventree Gallery on Kingsway.

Our space is limited so we can only take on one more artist at the time, and my preference is for a painter or multimedia artist, but... if you know a bunch of people who want to create another studio, there are three other spaces for lease in the area -- mostly around $1500 a month for 1500 square feet. I could get you the contact information for the landlords and we could turn this area of Kingsway into an artistic hub -- which would rock. It is not too far from Main and 16th, but closer to Fraser.

We are planning on moving in in September.

Please forward this information to your friends who are looking to bring their artistic expression to the forefront of their lives. Get in touch with me if you would like to know more.
Wanting to connect with other artists

Hello,

I've just joined this tribe, actually I have only recently joined Tribe. I am interested in connecting with other artists in vancouver. I returned to Vancouver almost a month ago after spending a year back in my home town, where I hung my first show at a small coffee shop that I would frequent. It was a very accomplishing feeling to see my paintings on a wall (other then my own). I would also like to connect with people who could point me in the right direction to hang my show again, or to possibly hang a new show. I've been working on my blog space lately, trying to make it feel more like a web site. Anyways, if anyone wants to check out more of my art (more then what there is to see on my tribe space) you can visit:
www.darenlucsasges.blogspot.com
I appreciate any comments on my work, also.

cheers,
Daren

i thought i'd start by welcoming artists to display their work, and say that we're always looking for new artists to show their work at the studio...it's downtown vancouver.

Heart of the World - A new venue for artists in Vabcouver

Jhayne Holmes has a plan for the Raja on Commercial and requires endorsements from people who would like to see another theatre in Vancouver for aritsts of all disciplines. Go to the website www.foxtongue.com, have a look and help in whatever way you can. Please send this to your email lists.

From the website -
_________________
Imagine buying a space and starting your own theatre, or your own art gallery, or your own movie theatre, or your own music hall. Imagine being able to host performances of all sorts- giving your creative friends space to perform or exhibit their work. I've got friends who are dancers and painters and lighting designers and actors and directors and writers and photographers and cinematographers... it would be
amazing to give them a space to create what they dream of, to be seen, heard, and appreciated.

I found an old cinema in Vancouver, built in 1910 and most recently used as a Bollywood house. It used to be The New York, where Neil Young and Sonic Youth once played. And it's up for sale.

I want to turn it into a 21st Century "multi-disciplinary arts facility featuring inspiring work from all over the globe that recaptures and surpasses its previous glory." And I want to call it Heart Of The World.

Housed in a classic 300 seat theatre built in 1910, the heyday of theatre, before any "leaky condo" fiasco, Heart of the World is to address the contemporary artistic and creative needs of the constantly evolving geographic location in which it is situated, offering competitive rates and a multi-faceted performance space. Complete with a full sized stage, a balcony with box seats, and a fully functional projection booth, the bones of the space hold limitless promise - able to show films, dance, theatrical productions, acoustic and amplified concerts, and cabaret events. In the foyer, artists both local and international will be able to advantageously display their work, whether it is photography, painting, drawing or sculpture. As a web presence, Heart of the World will offer podcasts of performances, a gallery of streaming video of performers, the chance to chat with featured artists, and up-to-date interviews, reviews and schedule listings.

How to help Jhayne:

So you don't have money or don't know what to say- make it short, make it sweet, don't say anything you don't mean, and copy-paste pass on the word to your friends/coworkers/contacts.

If you're contributing a few bucks, your endorsement can be merely, "My money's worth it." If you're willing to contribute time/energy, your endorsement can be "I'd sweep the stage," or "I'd stuff envelopes," or "I'd work on the theatre's electrics crew." If you don't think you can do those things, but you want to see this happen for your own entertainment purposes, your endorsement can be "I'd pay to see a performance at Heart of the World." If you live too far away, but you think this is a good idea, write "I wish Heart of the World were in my city," or merely "This is a great idea."

Be honest, and don't bite your tongue. Feel free to copy and paste, if any of these sentiments echo the words that are not coming from you.

Don't do this because I'm telling you to, though. Do this because you want to help or because you think it's a good idea.

Of special merit are local bands/theatre troupes/cinematographers/other performers and local entertainment patrons.

All you have to do is promise to go to a show.

Short and sweet means that potential contributors see more endorsements.

Love in All its Forms: Group Show for February

I am hoping to create a group show for February, with the tentative theme of "Love in all its Forms"

I want to showcase talents from many different disciplines and was imagining having paintings, mixed media, and photography on the wall...

but also having an opening and closing night with spoken word, music, performers of various natures, and possibly some video-poems or the like. The first night would set the tone of excitement for the rest of the month and the closing night would be a grand hurrah to say goodbye to the pieces and a last chance for folks to buy art.

The visual artists would likely be keen on just having their art on the wall, but maybe there could there be a hat passed or a cover to help show our appreciation for the talents and time of peformers on the opening and closing night.

If anyone interested in participating or helping create such an event, get a hold of me.
I am eyeing Rhizome as a location, but am open to suggestions.
